A continuación se describen los términos de uso y condiciones de contratación que han sido definidos por la Titular de la plataforma para su utilización.
La plataforma está sujeta a las normas y condiciones que se especifican a continuación. El hecho de registrarse en la misma implica que, como Usuario, aceptas expresamente estos términos y condiciones de uso.
Por lo tanto, te recomendamos que leas detenidamente estos Términos y Condiciones de Uso antes de registrarte y empezar a usar Wream. Si tienes alguna duda sobre las mismas, desde Wream ponemos a tu disposición la siguiente dirección de correo legal@wream.es para realizar cualquier consulta.
En caso de no estar conforme con los presentes términos de uso y condiciones de contratación, debes abstenerte de utilizar la plataforma.
Términos y condiciones de uso: se trata del presente documento que también es llamado “términos y condiciones” y que define las normas de utilización de la plataforma Wream.
Plataforma: Por plataforma nos referimos a la aplicación Wream, tanto si accedes a través de tu aplicación móvil para iOs y Android como si lo haces a través del sitio web www.wreamapp.com.
Usuario: Es la persona física que se registra en la plataforma a través de un nombre y contraseña.
Servicio: El servicio que ofrecemos es poner a tu disposición la plataforma para que puedas crear tus listas de deseos y compartirlas con tus amigos.
Wream: Wream, además de ser el nombre de la plataforma es el nombre que reciben todos los regalos que subas a tu lista de deseos. Un wream puede ser una prenda de ropa, un gadget, un libro, pero también puede ser un viaje o unas entradas para el teatro. Cualquier cosa que te gustaría regalar o que te regalen puede ser un wream.
Wream es una plataforma a la que puedes acceder a través de tu aplicación móvil iOS o android o a través de nuestro sitio web y es la aplicación para acertar siempre con los regalos. En Wream puedes subir foto de todo aquello que te gustaría que te regalaran, compartirlo con la gente que te sigue y, si tienes suerte, alguien te lo reservará para hacerte el regalo perfecto.
Crear y editar wreams: A través de tu perfil en Wream puedes crear y editar tus wreams. Para crear un wream sólo tienes que añadir el nombre, la fotografía, la categoría y el precio del producto que quieres subir. Si no sabes el precio del producto tendrás la opción de poner “precio desconocido”. También puedes añadir una descripción y otros datos útiles como la marca, una URL que enlace con el producto, la localización donde se puede encontrar. Podrás añadir el texto que quieras, cuanta más información des sobre tu Wream, más fácil se lo pondrás a tus amigos etc.
Encontrar amigos: Wream te permite, además de crear tus propios wreams, buscar a tus amigos y que les sigas, para poder ver sus propias listas y reservar sus wreams. Además, te permite añadir fechas importantes como cumpleaños, santos aniversarios o fechas importantes. Además, la app te irá avisando de fechas importantes de tus amigos para que no se te olviden.
Registro: El uso de Wream requiere el registro previo como usuario, para lo que será necesario que lleves a cabo los siguientes pasos:
Desde el momento de la aceptación de estos Términos y Condiciones de Uso, así como de la Política de Privacidad y registro, como usuario asumes las obligaciones y responsabilidades que se derivan de las mismas. Por ello, tanto el acceso a la plataforma como el uso o incorporación de información no consentida en la misma, es responsabilidad exclusiva de la persona que lo realiza, quedando exonerada la Titular de cualesquiera daños y/o perjuicios pudieran producirse a terceros por dicho uso, acceso o comunicación.
La contraseña para acceder a los servicios es personal e intransferible del Usuario, quien será el único responsable de mantener en secreto la misma y de las consecuencias de su pérdida, exonerando a la Titular de cualquier responsabilidad que pudiera derivarse del uso indebido de contraseñas por terceros no autorizados.
En tu perfil personal, a través del apartado denominado “configuración”, puedes editar tu información personal y cambiar tu contraseña, siendo tu responsabilidad la actualización de los mismos y tus preferencias. También puedes configurar tu perfil como privado o público. Si escoges la opción de perfil privado, sólo tus amigos podrán ver tu perfil en Wream, tus wreams, tus fechas, a quién sigues… Para que alguien pueda ver tu perfil si lo tienes configurado como privado, deberá realizarte una solicitud de seguimiento y que tú la aceptes.
Si en cualquier momento quieres darte de baja en Wream, puedes hacerlo enviando un correo a legal@wream.es indicando en el asunto “baja de usuario” y nosotros procederemos a eliminar tu cuenta. Para poder usar Wream de nuevo, deberás registrarte y crear una nueva cuenta.
Como usuario, te comprometes a hacer un uso adecuado de los servicios que se ofrecen en la plataforma y te comprometes a no incorporar información o contenidos en la Plataforma:

La plataforma y su contenido se rige por la legislación española en materia de propiedad intelectual.
La tecnología y el contenido de la Plataforma se encuentra protegido por derechos de autor. Los textos, dibujos, fotografías y demás elementos audiovisuales contenidos en la Plataforma y aportados por la Titular son titularidad exclusiva de la Titular.
En ningún caso se entenderá que el acceso y navegación del Usuario en la Plataforma implica una renuncia, transmisión licencia o cesión total ni parcial de dichos derechos por parte de la Titular. Está prohibido modificar, copiar, reutilizar, explotar, reproducir, comunicar públicamente, cargar archivos, enviar por correo, transmitir, usar, tratar o distribuir de cualquier forma la totalidad o parte de los contenidos incluidos en este sitio web para propósitos públicos o comerciales, si no cuenta con la autorización expresa y por escrito de la Titular.
El uso no autorizado de los contenidos incluidos en esta Plataforma y, con carácter general, la lesión de los derechos de propiedad intelectual de la Titular derivarán en responsabilidades legales contra el infractor.
La Titular es titular de signos distintivos, marcas y el propio nombre de dominio al que apunta el sitio web de Wream. Está prohibido suprimir, manipular o eludir los presentes términos y condiciones de uso puestos a disposición de los usuarios a través de la plataforma, o suprimir o manipular cualquier dato de identificación de la titularidad de estos derechos.
Las marcas y otros signos distintivos de terceros, que utilices para tus deseos, deben tener el único propósito de identificar correctamente los productos y servicios que deseas adquirir o que te sean obsequiados.
Como Usuario, manifiestas y garantizas con respecto a los contenidos que aportes a la Plataforma, que son de su titularidad y por lo tanto, ostentas todos los derechos de explotación; o bien que cuentas con las autorizaciones o las licencias necesarias de los titulares de las mismas para su reproducción, distribución, y comunicación al público.
Como Usuario, mantendrás indemne a la Titular ante cualquier denuncia de terceros, ya sea judicial o extrajudicial, motivada por infracción de derechos de propiedad intelectual o bien, porque afecte o lesione derechos de terceros.
Como Usuario, otorgas a la Titular una licencia de uso, reproducción, comunicación pública o puesta a disposición y transformación (este último para ajustar los contenidos subidos a los requisitos de tamaño y resolución que soporta la Plataforma al subir los archivos), con carácter gratuito, no exclusivo, para un ámbito geográfico mundial sobre la información y los contenidos que incorpore en la Plataforma con la finalidad de poder reproducir los mismos y ponerlos a disposición de los demás usuarios dentro de la propia Plataforma. Dicha licencia finalizará cuando el Usuario cause baja en la Plataforma por cualquier motivo. Sin perjuicio de la licencia otorgada a la Titular, cada Usuario puede incorporar las advertencias sobre reserva de derechos y limitaciones de uso de sus contenidos para los demás usuarios y terceros que considere pertinentes y que correspondan conforme a sus derechos sobre los contenidos que comparte.
Cualquier acto de ingeniería inversa que implique descompilar los elementos informáticos que forman parte de la plataforma, será considerado como una infracción de los derechos de propiedad intelectual titularidad de la Titular y/o de terceras partes.
La Titular no puede asumir responsabilidades por los contenidos de otros sitios web que puedan dirigir enlaces hacia cualquiera de las páginas de este sitio web o bien, hacer referencia al servicio prestado, con información que pueda inducir a error a los usuarios, en relación a los servicios de esta plataforma.
La Titular se limita a poner a disposición de los usuarios la plataforma para que puedan subir sus listas de deseos y compartirlas con el resto de usuarios. En ningún caso la Titular es propietaria ni distribuidora de los productos que puedan enlazarse en la plataforma, siendo responsables en exclusiva los usuarios de garantizar la veracidad, licitud y exactitud de los productos que puedan enlazar en sus perfiles. Por tanto, la Titular no se responsabilizará en ningún caso de los daños y perjuicios derivados del uso que hagan los usuarios de la plataforma.
La Titular se compromete a poner todos los medios en su mano para garantizar el correcto funcionamiento de la Plataforma en todo momento y a que, en caso de existir fallos de accesibilidad, llevará a cabo todas las acciones necesarias para subsanarlos. No obstante, la disponibilidad de la Plataforma puede verse alterada por labores de mantenimiento y mejora.
La Titular establecerá todas las medidas de seguridad acordes al estado de la técnica para que la utilización de la Plataforma esté libre del ataque de virus o de terceros que puedan afectar a los sistemas de los Usuarios. No obstante, la seguridad absoluta no existe y, en caso de que la Titular detectara la existencia de algún ataque que pudiera afectar a los usuarios, suspenderá el acceso a la Plataforma hasta solucionar el problema.
La Titular no se hace responsable de los daños que puedan causarse en los sistemas informáticos con los que el usuario accede a la Plataforma, ficheros o datos almacenados en los mismos como consecuencia de virus o cualquier tipo de código malicioso (malware), siempre que la Titular haya establecido las medidas adecuadas de protección conforme a los estándares del mercado y el estado de la tecnología para evitarlos. La Titular tampoco se hace responsable de la utilización inadecuada del dispositivo informático por parte del Usuario o el acceso con herramientas inapropiadas para la Plataforma.
La Titular no se responsabiliza de posibles opiniones vertidas en sitios web o foros de opinión ajenos a la Titular que, refiriéndose a los servicios de la Plataforma o a otras empresas, puedan suponer un descrédito o menosprecio directo o indirecto a aquellas otras empresas.
La Titular tampoco es responsable de los comentarios o contenidos que generen los Usuarios Registrados haciendo uso de las herramientas puestas a su disposición en la Plataforma. No obstante, de tenerse conocimiento por parte de la Titular de que alguno de esos comentarios puede perjudicar o denigrar de manera alguna a terceros, la Titular se reserva el derecho a retirarlos de la Plataforma.
En la Plataforma, el Usuario puede acceder a enlaces a otras páginas web, mediante banners, links u otro tipo de accesos. La Titular no tiene facultad para controlar los contenidos facilitados por otros sitios web a los que se establecen enlaces desde la Plataforma. Por lo tanto, la Titular no asume responsabilidad alguna sobre cualquier aspecto relativo a dichos sitios web, ni garantiza que los enlaces puedan estar exentos de virus u otros elementos que puedan producir daños en los sistemas informáticos o archivos del usuario.
La Titular no se hace responsable de los contenidos de los sitios web que puedan dirigir enlaces hacia esta Plataforma o hacer referencia a la misma o que incluyan opiniones sobre la Plataforma de la Titular que puedan inducir a error a los Usuarios acerca de los servicios de la Titular.
La Titular se reserva el derecho a retirar, restringir y/o denegar el acceso a la plataforma, sin previo aviso, a los correos electrónicos con determinados dominios, o a usuarios de determinados países, por imperativo legal, orden judicial o administrativa, o razones de seguridad de la propia empresa, su infraestructura o sus servicios o por razones de negocio.
Las condiciones de uso y sus futuras versiones estarán en todo momento accesibles en el presente sitio web. La Titular se reserva la facultad de realizar las modificaciones que considere necesarias en estas condiciones de uso, circunstancia de la que se advertirá al usuario mediante un control de versiones de las mismas.

Terms and conditions of use: it is this document that is also called “terms and conditions” and that defines the rules for using the Wream platform.
Platform: By platform we mean the Wream application, whether you access it through your mobile application for iOS and Android or through the website www.wreamapp.com.
User: It is the natural person who registers on the platform through a name and password.
Service: The service we offer is to make the platform available to you so that you can create your wish lists and share them with your friends.
Wream: Wream, in addition to being the name of the platform, is the name that all the gifts that you upload to your wish list receive. A wream can be a piece of clothing, a gadget, a book, but it can also be a trip or theater tickets. Anything you would like to give away or get gifted can be a wream.
Wream is a platform that you can access through your iOS or Android mobile application or through our website and it is the application to always get gifts right. In Wream you can upload a photo of everything you would like to be given as a gift, share it with the people who follow you and, if you are lucky, someone will reserve it for you to make the perfect gift.
Create and edit wreams: Through your Wream profile you can create and edit your wreams. To create a wream you just have to add the name, the photo, the category and the price of the product you want to upload. If you do not know the price of the product, you will have the option to put “unknown price”. You can also add a description and other useful information such as the brand, a URL that links to the product, the location where it can be found. You can add the text you want, the more information you give about your Wream, the easier it will be for your friends, etc.
Find friends: Wream allows you, in addition to creating your own wreams, to search for your friends and to follow them, to be able to see their own lists and reserve their wreams. In addition, it allows you to add important dates such as birthdays, holy anniversaries or important dates. In addition, the app will notify you of important dates of your friends so that you do not forget them.
Registry: The use of Wream requires prior registration as a user, for which it will be necessary to carry out the following steps:
From the moment of acceptance of these Terms and Conditions of Use, as well as the Privacy Policy and registration, as a user you assume the obligations and responsibilities that derive from them. Therefore, both access to the platform and the use or incorporation of non-consensual information in it, is the sole responsibility of the person who performs it, the Holder being exonerated from any damages and/or losses that may occur to third parties due to said use, access or communication.
The password to access the services is personal and non-transferable. The User will be solely responsible for keeping it secret and for the consequences of its loss, exonerating the Holder of any liability that may arise from the misuse of passwords by unauthorized third parties.
In your personal profile, through the section called “settings”, you can edit your personal information and change your password, being your responsibility to update them and your preferences. You can also set your profile as private or public. If you choose the private profile option, only your friends will be able to see your profile in Wream, your wreams, your dates, who you follow... In order for someone to see your profile if you have it configured as private, they must make a follow-up request and that you accept it.
If at any time you want to unsubscribe from Wream, you can do so by sending an email to legal@wream.es indicating in the subject “user unsubscribe” and we will proceed to delete your account. In order to use Wream again, you will need to register and create a new account.
As a user, you agree to make appropriate use of the services offered on the platform and you agree not to incorporate information or content on the Platform:

The technology and content of the Platform is protected by copyright. The texts, drawings, photographs and other audiovisual elements contained in the Platform and provided by the Owner are the exclusive property of the Owner.
In no case will it be understood that the User's access and navigation on the Platform implies a waiver, license transfer or total or partial transfer of said rights by the Owner. It is prohibited to modify, copy, reuse, exploit, reproduce, publicly communicate, upload files, send by mail, transmit, use, process or distribute in any way all or part of the contents included in this website for public or commercial purposes, if you do not have the express and written authorization of the Owner.

The brands and other distinctive signs of third parties, which you use for your wishes, must have the sole purpose of correctly identifying the products and services that you wish to acquire or that are given to you.
As a User, you declare and guarantee with respect to the content that you contribute to the Platform, which is your property and therefore, you hold all the exploitation rights; or that you have the necessary authorizations or licenses from their owners for their reproduction, distribution, and communication to the public.
As a User, you will hold the Holder harmless from any third party complaint, whether judicial or extrajudicial, motivated by infringement of intellectual property rights or because it affects or damages the rights of third parties.
As a User, you grant the Holder a license to use, reproduce, publicly communicate or make available and transform (the latter to adjust the uploaded content to the size and resolution requirements supported by the Platform when uploading files), free of charge, non-exclusive, for a worldwide geographic scope over the information and content you incorporate into the Platform in order to reproduce it and make it available to other users within the Platform itself. Said license will end when the User cancels the Platform for any reason. Without prejudice to the license granted to the Owner, each User may incorporate the warnings on the reservation of rights and limitations of use of their contents for other users and third parties that they consider pertinent and that correspond according to their rights over the contents they share.
Any act of reverse engineering that involves decompiling the computer elements that are part of the platform, will be considered as an infringement of the intellectual property rights owned by the Owner and/or third parties.
The Owner cannot assume responsibility for the contents of other websites that may direct links to any of the pages of this website, or refer to the service provided, with information that may mislead users, in relation to the services of this platform.
The Owner is limited to making the platform available to users so that they can upload their wish lists and share them with other users. In no case is the Owner the owner or distributor of the products that can be linked on the platform, the users being exclusively responsible for guaranteeing the veracity, legality and accuracy of the products that they can link in their profiles. Therefore, the Owner will not be responsible in any case for damages arising from the use made by users of the platform.
The Owner undertakes to use all the means in his hand to guarantee the correct functioning of the Platform at all times and that, in the event of accessibility failures, he will carry out all the necessary actions to correct them. However, the availability of the Platform may be altered by maintenance and improvement work.
The Owner will establish all the security measures according to the state of the art so that the use of the Platform is free from the attack of viruses or third parties that may affect the Users' systems. However, absolute security does not exist and, in the event that the Owner detects the existence of an attack that could affect users, it will suspend access to the Platform until the problem is solved.
The owner is not responsible for any damage that may be caused to the computer systems with which the user accesses the Platform, files or data stored therein as a result of viruses or any type of malicious code (malware), provided that the Holder has established adequate protection measures in accordance with market standards and the state of technology to avoid them. The Owner is not responsible for the inappropriate use of the computer device by the User or access with inappropriate tools for the Platform.
The Owner is not responsible for possible opinions expressed on websites or opinion forums outside of the Owner that, referring to the services of the Platform or to other companies, may directly or indirectly discredit or disparage those other companies.
The Owner is not responsible for the comments or content generated by Registered Users using the tools made available on the Platform. However, if the Owner becomes aware that any of these comments may harm or denigrate third parties in any way, the Owner reserves the right to remove them from the Platform.
On the Platform, the User can access links to other web pages, through banners, links or other types of access. The Owner does not have the power to control the content provided by other websites to which links are established from the Platform. Therefore, the Owner does not assume any responsibility for any aspect related to said website, nor does it guarantee that the links may be free of viruses or other elements that may cause damage to the user's computer systems or files.
The Owner is not responsible for the contents of the websites that may direct links to or refer to this Platform or that include opinions about the Owner's Platform that may mislead Users about the services of the Holder.
The Owner reserves the right to withdraw, restrict and/or deny access to the platform, without prior notice, to emails with certain domains, or to users from certain countries, due to legal imperative, judicial or administrative order, or reasons of security of the company itself, its infrastructure or its services or for business reasons.
The conditions of use and their future versions will be accessible at all times on this website. The Owner reserves the right to make the modifications it deems necessary in these conditions of use, a circumstance of which the user will be warned by means of a version control of the same.
